§ 24-9. Resubdivision of land.

  • For any change in a map of an approved or recorded subdivision plat, if such change affects any street layout shown on such map, or area reserved thereon or public use (easements), or if it affects any map or plan legally approved and recorded prior to the adoption of any regulations controlling subdivisions, such parcel shall be approved by the planning commission by the same procedure, rules and regulations as for a subdivision. However, the public works director or city planner may administratively approve replats for parcels as specified in section 28-142 (Definitions, "zoning lots") of this Code of Ordinances as follows: A) one or more portions of a lot in one or more recorded subdivision plats; B) a combination of portions of lots or entire lots in one or more recorded plats, together with unplatted land; C) a portion of less than five (5) acres of unplatted land; or D) one or more unplatted parcels and containing less than five (5) acres.
